Cevap veriyorum; İKİSİ DE! 

Botanikte domates meyvedir.

Gastronomide ise domates sebzedir.

Eğer bir bitki çiçekten oluşuyorsa ve tohum taşıyorsa bu meyve kabul edilir ve domateste çiçekten oluşur, içinde tohum taşır bu yüzden meyve olarak tanımlanabilir.

Gastronomide ise sınıflandırma tat ve kullanım temeline dayanır. 

Domatesi de diğer meyveler gibi tatlı bir şekilde yemediğimiz, salata çorba ve soslardaki ana bileşen olabildiği ve tariflerde sebze gibi kullanıldığı için sebzedir.

Hatta bununla ilgili Amerikada bir mahkeme olmuş!

Vergiden kaçmaya çalışılırken ortaya atılmış, zorlama bir dava. Ayrıntılarını incelersek;

Dava: Nix Hedden Davası

Yıl:1893

Olay Newyork limanında geciyor. O dönemde sebzeler, meyvelere göre daha fazla gümrük vergisine sahip olduğu için  domates ithalatı sırasında ithalatçı John Nix, domatesin botanik olarak meyve olduğunu savunup vergi ödemek istemiyor. New York Gümrük müdürü Edward Hedden ise domates yemeklerde sebze gibi kullanıldığı için sebze vergisi ödemelisin diyerek Nix’in savunmasına karşılık veriyor.

Davada Nix, botanik kitaplarından alıntılar yaparak kendi görüşünü savunmaya devam ederken Hedden ise tarif örneklerini göstererek kendı savunmasını yapıyor ve bu dava saatlerce sürüyor!

Bu dava hakimler tarafından saatlerce dinlendikten sonra 22 mayıs 1893’te ABD Yüksek mahkemesi sonuca varmış ve özetle ‘Halkın günlük dilinde domates sebzedir. Vergi kanunları halkın kullanımına göre yorumlanır’ diyerek davayı sonlandırmış.

Ve domates gümrük vergisi için hukuk doğrusunda sebze sayılmış..

Yani gerçekten vergi ödememek icin bu kadar çabaya gerek var mıydı ?  Neyse ne demişler umut fakirin ekmeğidir… sevgiler ❤ 

One of the topics that has been occupying everyone’s mind lately is this very question. Is a tomato a fruit or a vegetable?
I’ll answer it: Both!

In botany, a tomato is a fruit.
But in gastronomy, it’s considered a vegetable.

If a plant develops from a flower and contains seeds, it is classified as a fruit, and since tomatoes grow from a flower and carry seeds, they can be defined as fruits.
In gastronomy, however, classification is based on taste and usage.
Since we don’t eat tomatoes in a sweet way like other fruits, and because they are used as a main ingredient in salads, soups, and sauces, they are considered vegetables.

In fact, there was even a court case about this in America!
It was quite a forced lawsuit that came up in an attempt to avoid taxes. Let’s look into the details:

Case: Nix v. Hedden
Year: 1893

The event took place at the Port of New York. At the time, vegetables were subject to higher import duties than fruits. So during the import of tomatoes, importer John Nix argued that tomatoes are botanically fruits and refused to pay the vegetable tax. New York customs collector Edward Hedden countered by saying that tomatoes are used like vegetables in cooking, so he must pay the vegetable tariff.

During the trial, Nix quoted botanical books to support his view, while Hedden presented recipe examples to defend his argument, and this debate went on for hours!

After listening to the case for hours, on May 22, 1893, the U.S. Supreme Court reached a conclusion and essentially stated:
“In the common language of the people, a tomato is a vegetable. Tax laws are interpreted according to everyday usage.”
And so, legally, tomatoes were deemed vegetables for customs purposes.

I mean, was it really necessary to go to all this effort just to avoid paying taxes? Anyway, as the saying goes, hope is the poor man’s bread…
